LiftCue
End-User License Agreement
Terms and conditions for using LiftCue.
LiftCue End-User License Agreement
This agreement is between you and Zetegy LLC. It covers the LiftCue application and updates supplied by Zetegy unless an update comes with separate license terms. You accept this agreement by installing or using LiftCue. Apple is not a party to this agreement. Zetegy is solely responsible for LiftCue and its content.
Your license
Zetegy grants you a personal, nonexclusive, nontransferable license to use LiftCue on compatible Apple-branded devices you own or control, subject to the applicable App Store Usage Rules. Other accounts associated with the purchaser may access and use the app where those rules permit Family Sharing or volume purchasing. Apple Media Services Terms and Conditions.
Zetegy and its licensors retain ownership of the software and its included materials. This license does not transfer ownership of your workout records to Zetegy. You may not resell, sublicense, redistribute, modify, decompile or reverse engineer LiftCue, except to the extent that applicable law or the license for an open-source component permits it. When using LiftCue, you must comply with applicable third-party agreements, including those for the Apple services you use.
Support, warranties and claims
Zetegy is responsible for any maintenance or support it has agreed to provide or that applicable law requires. Apple has no obligation to provide support or maintenance for LiftCue.
Zetegy supplies LiftCue as is and disclaims implied warranties to the extent permitted by law. Zetegy is solely responsible for warranties that apply despite this disclaimer. If LiftCue fails to meet an applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the application. To the fullest extent the law permits, Apple's warranty obligation ends with that refund. Zetegy is solely responsible for other claims, losses, damages, liabilities, costs or expenses resulting from that warranty failure.
Zetegy has sole responsibility for addressing claims from you or a third party concerning LiftCue or your possession or use of it. These include product liability, failure to comply with legal or regulatory requirements, and consumer protection and privacy claims, including claims relating to LiftCue's use of HealthKit. If a third party claims that LiftCue or your possession or use of it infringes intellectual property rights, Zetegy alone is responsible for investigating, defending, settling and satisfying that claim. This agreement preserves all rights and remedies that applicable law does not allow you to waive.
Export compliance
You represent and warrant that you are neither in a country subject to a U.S. government embargo nor in one the U.S. government designates as supporting terrorism, and that you are not on a U.S. government list of prohibited or restricted parties.
Termination
You may end this license by ceasing use of LiftCue and removing the app from your devices. If you breach the license, your right to use the app ends and you must stop using it. Ending the license or deleting the app does not cancel an App Store subscription. The LiftCue Terms and Conditions explain how to cancel.
Apple's right to enforce this agreement
You and Zetegy agree that Apple and its subsidiaries are third-party beneficiaries. Upon your acceptance, Apple is deemed to have accepted its right to enforce this agreement against you as a third-party beneficiary.
